1. Definitions
In these Terms and Conditions:
- "We," "Us," or "Our" refers to silkpivopmy, a watch repair service operating at 38 Jalan Imbi, 55100 Kuala Lumpur, Malaysia
- "You" or "Client" refers to any individual or entity using our services
- "Services" refers to watch repair, maintenance, and appraisal services we provide
- "Timepiece" refers to any watch or clock submitted for service
- "Agreement" refers to these Terms and Conditions along with any service order or estimate
2. Acceptance of Terms
By engaging our services, submitting a timepiece for repair, or requesting an estimate, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.
You must be at least 18 years of age to enter into this agreement. By using our services, you represent that you are of legal age and have the capacity to enter into binding agreements.
3. Service Description
We provide the following services:
- Hairspring Correction: Diagnosis and correction of hairspring irregularities
- Complete Swiss Calibre Service: Full movement overhaul for ETA, Sellita, and Valjoux calibres
- Watch Insurance Appraisal: Written valuation for insurance purposes
Service availability is subject to our technical capabilities and parts availability. We reserve the right to decline service on timepieces we deem beyond our scope of expertise or for which proper parts cannot be obtained.
4. Service Process and Estimates
Our service process involves:
- Initial examination of your timepiece
- Provision of written estimate including scope of work and cost
- Your approval before proceeding with service
- Completion of agreed-upon work
- Notification when timepiece is ready for collection
Estimates are valid for 30 days from issuance. If additional work becomes necessary during service, we will contact you for approval before proceeding. You are not obligated to approve additional work, though this may affect the final functionality of your timepiece.
Estimated turnaround times are provided in good faith but are not guarantees. Delays may occur due to parts availability, complexity of repairs discovered during service, or circumstances beyond our control.
5. Payment Terms
Payment is due upon collection of your serviced timepiece. We accept:
- Cash (Malaysian Ringgit)
- Bank transfer to our designated account
- Credit/debit cards (subject to processing fees)
All prices are in Malaysian Ringgit (MYR) and include applicable Malaysian taxes. Prices are as follows:
- Hairspring Correction: MYR 680
- Complete Swiss Calibre Service: MYR 2,600
- Watch Insurance Appraisal: MYR 190
If payment is not made within 60 days of service completion notification, we reserve the right to dispose of the timepiece to recover service costs, after providing written notice.
6. Client Responsibilities
You agree to:
- Provide accurate information about your timepiece, including any known issues or prior repairs
- Inform us if the timepiece has sentimental, historical, or exceptional monetary value
- Respond to communications regarding service progress or required approvals in a timely manner
- Collect your timepiece within a reasonable time after service completion notification
- Verify that your timepiece is functioning properly upon collection
7. Limitation of Liability
While we exercise utmost care in handling your timepiece, watch repair involves inherent risks. Our liability is limited as follows:
- Our maximum liability for any claim is limited to the lesser of: (a) the actual service cost you paid, or (b) MYR 5,000
- We are not liable for pre-existing damage, wear, or defects not disclosed during initial examination
- We are not liable for damage resulting from your failure to follow care instructions provided after service
- We are not liable for consequential, indirect, or special damages including lost profits or sentimental value
For timepieces with exceptionally high value, we recommend obtaining separate insurance coverage. We can provide documentation for insurance purposes but assume no liability beyond the limits stated above.
8. Service Warranty
We warrant our workmanship for 12 months from service completion date. This warranty covers:
- Defects in our repair work or parts we installed
- Failure of specifically repaired components to function as intended
This warranty does not cover:
- Normal wear and tear or battery depletion
- Damage from accidents, misuse, or neglect after service
- Water damage if the timepiece was not serviced for water resistance
- Damage caused by unauthorized repairs by third parties
- Components we explicitly declined to repair or replace
Warranty service requires presentation of your original service receipt and does not extend the original warranty period.
9. Intellectual Property
All content on our website, including text, graphics, logos, and images, is the property of silkpivopmy and protected by Malaysian and international copyright laws. You may not reproduce, distribute, or create derivative works without our written permission.
Service documentation we provide (timing reports, appraisal documents) are for your personal use only and may not be reproduced for commercial purposes.
10. Indemnification
You agree to indemnify and hold silkpivopmy harmless from any claims, damages, or expenses arising from: (a) your breach of these Terms and Conditions, (b) your violation of any laws or third-party rights, or (c) your submission of counterfeit, stolen, or illegally obtained timepieces for service.
11. Termination of Service
Either party may terminate the service agreement before work begins, without penalty. Once service has commenced:
- You may cancel service but will be charged for work completed to that point plus reassembly costs
- We may refuse to complete service if we discover the timepiece is stolen, counterfeit, or service would violate applicable laws
12. Dispute Resolution and Governing Law
These Terms and Conditions are governed by the laws of Malaysia. Any disputes arising from our services shall be subject to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.
Before initiating legal action, we encourage you to contact us at [email protected] to seek an amicable resolution. We commit to good-faith negotiation of any disputes.
If negotiation fails, either party may pursue resolution through the Small Claims Tribunal or appropriate Malaysian courts, depending on the claim amount.
13. Disclaimers
Our services are provided "as is" without warranties of any kind, except as explicitly stated in Section 8 (Service Warranty). We make no guarantees regarding:
- The long-term reliability of vintage or previously repaired movements
- The availability of specific replacement parts
- The exact accuracy of mechanical timepieces (typical variance is stated as seconds per day)
- The appreciation or depreciation of your timepiece's market value
14. General Provisions
Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in full effect.
Waiver: Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.
Assignment: You may not transfer your rights or obligations under this agreement without our written consent.
Entire Agreement: These Terms, together with any service estimate or order, constitute the entire agreement between you and silkpivopmy regarding our services.
15. Changes to Terms
We may update these Terms and Conditions periodically. Changes will be posted on our website with an updated "Last Updated" date. Material changes will be communicated via email to clients with active service orders.
Your continued use of our services after changes are posted constitutes acceptance of the revised Terms. Service orders submitted before changes take effect remain subject to the Terms in effect at the time of submission.
